    How This Visa Works

    You have to be in Australia on a subclass 444 visa. Your family members included on the application can be in Australia or overseas. If they are in Australia, they would need to hold a substantive visa or a Bridging A, B or C visa. Once you lodge the application, they would receive a bridging visa allowing them to remain in Australia until your visa application is assessed.

     

    Who Is Eligible For This Visa?

    General Requirements:

    • You are in Australia as a subclass 444 visa holder.
    • You came here on or before 19 February 2016.
    • You have been usually resident in Australia for a continuous period of at least 5 years.
    • For each of the 4 most recently completed income years your taxable income was at or above a specific income threshold:

    • In limited circumstances, such as if you were receiving compensation for an injury or you were on an approved parental or carer’s leave from your usual employment you may still apply for and be granted a subclass 189 visa under New Zealand stream although for each or some of the 4 most recently completed income years your taxable income was lower than a specific income threshold.


    What Does Visa Let You Do?

    You can include the following types of family members in your application:

    • Spouse, de-facto partner (including the same-sex partners)
    • Dependent children up to 23yo unless they are financially dependent on you as they are not able to work due to their physical or mental condition.

    This is a Permanent Visa. It lets you:

    • stay in Australia indefinitely
    • work and study in Australia
    • enrol in Medicare, Australia’s scheme for health-related care and expenses
    • sponsor eligible relatives for permanent residence
    • travel to and from Australia for five years
    • apply for Australian citizenship, if eligible.

    Frequently asked questions

    • Now the 457 visas are no longer available, what are my options?

      In March 2018,457 visas were abolished and replaced with the completely new Temporary Skill Shortage (TSS) visa, Subclass 482.

      The new TSS visa programme has two streams of occupations – short-term (STSOL) and long-term (MLTSSL) Only occupations on the MLTSSL list can apply for PR after 3 years. There are a bunch of other changes. Please visit Employer Sponsorship Visas to find out more.

    • What are the Transitional Arrangements if I held a 457 visa or applied for a 457 visa prior to 18th April 2017

      If you held, or had applied for, a Subclass 457 visa as at April 18, 2017 then you can still meet transitional arrangements.

      Temporary Residence Transition requirements which apply

      • Occupation list requirements will not apply
      • The age requirement will remain at less than 50 years of age with existing age exemptions still available, and
      • The minimum period an applicant is required to have been employed in their nominated occupation as the holder of a subclass 457 or TSS visa will remain at two years.

      New requirements apply (e.g. new age requirements and three -year transitional period on a temporary visa).

    • Resident Return Visas – What are my Options?

      Living in Australia for at least two years (can be accumulative) in the last 5 years prior to lodging your visa you will automatically be granted a new 5 -year Permanent Residence Visa.

      If you have spent less than 2 years in Australia, then you may be eligible for a one-year RRV. You would need to present ties you have to Australia such as employment, investment, family or business ties.
